The Village of Chippewa Lake Council met in
regular session on Monday, October 12, 2009 at the Church at the Lake located
at 7824 Lake Road, The
Honorable Joanne Dodaro called the meeting to order at 7:30 pm.
All in attendance stood for the Pledge of
Allegiance.
Present: Mayor Joanne Dodaro, Clerk-Treasurer Cathy Osborn,

Motion
made by Sommers to pay the bills from their proper funds. Riedel seconded. 6 Ayes. Motion approved.
Mayor Dodaro said that we have some guests
with us tonight and we will start out with Michael Barnhart who is on the
Medina County Drug Task Force. Mike
explains they are an undercover independent drug task force and they work with
the sheriff’s office, but they are independent from them. They handle all the drug investigations
throughout the county. Their mission is
to identify, investigate and aid in the prosecution of drug related
offenses. They don’t
primarily look at drug abuse. Their
major investigations concentrate on trafficking, cultivation and
manufacturing. He wanted to introduce
himself and let the residents know they do investigate all complaints and are
willing to set up surveillance equipment as needed. He said sometimes
investigations take several months to complete. They do have a website at: www.mcdtf.org
where you can view drug identification and they also offer classes. Mike will attend to give his presentation at
the Neighborhood Watch meeting on November 12th. The renewal for this levy will be on the next November ballot in 2010.
Mayor Dodaro introduces Scott Varney of
Varney, Fink & Associates who is the IPA (Independent Public Accountant)
who does the village’s state audit every two years. Cathy has invited Scott here tonight to be introduced to the Mayor and Council. Cathy will begin to work with Varney, Fink
& Associates in the spring of 2010 for the village’s 2008 & 2009 state
audit.

Cathy has received the cost from Varney, Fink
& Associates for the two year audit which will
cost the village $8,700.00. Cathy adds
that is only $300.00 more than the last audit done two years ago. There
will be additional cost by the Auditor of State for reviewing and approving the
final audit work done by Varney, Fink & Associates. Cathy said she doesn’t
have any questions for Scott tonight.
She adds that she worked with several of his staff and they were
pleasant to work with. Robbins asks
during an audit with this are you validating by letter bill payments like in a
business audit?
Scott said they are auditing the financial statements and checking to
see if they are fairly presented. They also check compliance with the Ohio
Revised Code. The Law Director adds this audit is required by state law. Robbins said in a business audit when you are
paying bills they send out a letter to verify it’s a
real company and not a fake company. A
lot of fraud is on a fake company. Cathy
states “We don’t do that here!” Cathy said we used to have to go through the
State Auditor’s Office and the examiners from the state would spend 2-3 weeks
doing the audit on site. They would call
for all kinds of things including toilet paper.
We had several audits completed with no monetary citations so we
qualified for an IPA audit. Our IPA
audits are performed in the office of the firm. Cathy said she no longer provides the toilet
paper, but plenty of other paperwork.
Robbins asks if Varney, Fink & Associates were located locally and
Cathy said yes they are on College Street in Wadsworth. Cathy gave thanks to Scott for attending tonight’s meeting.
The Law Director will review the contract and it will
be addressed later.

Mayor Dodaro introduces Mr. Daryl Kubilis who
is the Superintendent of Cloverleaf Local School District and Mr. Mike Maloney
who is the Community Information Coordinator.
Mr. Kubilis said the good news is that he is not here today to talk
about a school levy. He brought a model
of the new elementary school that will be built on
Buffham Road. He explained where the
buses will drop off students and where parents can drop off their
student(s). He said the parents will no longer have to fight the buses to get into the
driveway. He said five minutes after the
final bell rings then all doors except one will lock
automatically making this building our safest building in the district. He
said the student body as of right now is just over 3,000 students. He reviewed the school’s mission and strategy
planning. Mr. Kubilis thanks Mayor and
Council for their time to allow this presentation to the community. Mayor Dodaro thanked them for attending tonight’s meeting.
Jerry from the Medina County Auditor’s office
announced that Michael Kovack has received the “Above and Beyond Award”. He was presented
with this award on October 8, 2009 at the ESOP (Enpowering and Strengthening
Ohio’s People) Gala Celebration held at the Crowne Pointe Hotel in
Cleveland. Last year Auditor Kovack partnered with ESOP to assist homeowners that were having
difficulty with their mortgage payments in Medina County. Their office has helped over 600 families
this year. Auditor Kovack has promoted
the assistance available through the ESOP program which
has made Medina County a leader throughout the state in addressing this problem
head on.

Committee Reports
Safety: Fire Chief Jeff Hall distributed the August
2009 Activity Report. (See attached) The report shows that there were five EMS
calls for the month of August and zero fire calls in the village. The year to date totals for the village are
15 fire calls and 32 EMS calls.
Chief Hall also reported that the bath house at
the old Chippewa Lake Park has been taken down.
The debris hasn’t
been hauled away yet, but it is in a pile now.
The hazard has been cut in half now.
Claire List gave her thanks from all the members of the Neighborhood
Watch who attended their first aid course recently. The
Neighborhood Watch will work with the fire department to set up another CPR
class.
Hunter read the patrol report for the month of September as
follows: 3 hours in court, 9 calls
assigned by dispatch, 3 self initiated calls, 117 vacation watches, 138 citizen
contacts, 3 traffic stops, 4 citations issued, 2 warnings issued, 8 suspicious
persons, 8 suspicious vehicles, 3 assist to other police departments and 1
presence at a fire-rescue call. The
deputies worked a total of 138 hours for the month. They logged 691.6 miles on the cruiser using
73.5 gallons of gasoline. (See attached)
Hunter reports the village has had a few incidents with unsupervised
teenagers. Two weeks ago
some dogs that were fenced in were shot at with a BB gun.

Safety
(Continued): Hunter further reports that there was quite a
bit of vandalism on Craggy Creek and Willow Wood about a week ago. Hunter said that a lot of this vandalism is
happening in the early morning hours which is a clear
violation of the curfew ordinance. A
resident reports that there was a house in Hunters Run that
was spray painted with a gang name (commonly known as tagging).
Hunter strongly suggests that residents be active in protecting the
community by calling the police when you see something that looks
suspicious.
Mayor Dodaro said the village did have an officer on duty the night that
a lot of this vandalism was going on.
She is concerned that the deputy was not aware of any of it. Hunter, Deputy Easterday, Law Director Allan
M. Michelson and Mayor Dodaro will meet with Sheriff Hassinger next Monday to
discuss many issues of concern.
Deputy Easterday will be on duty on the night of Halloween. He will be passing out crayons and candy for
the young children in the village.
Zoning: A Zoning Work Session was
held on Thursday, September 17, 2009 at the Village Hall. (See
attached minutes) The Clerk-Treasurer Cathy Osborn received a phone call
from a resident at 180 Brookshore regarding a resident at 162 Brookshore
burning his trash. Locher will visit the
site and speak with the owner about this.

Zoning
(Continued): A
question concerning the Schmitt rental came up.
The rental appears to have been in place before zoning took effect. Michelson does not recommend any action at
this time.
The
Law Director was asked what our next steps were
concerning the Wolff property at 90 Longacre Lane. Mr. Wolff has until October
15, 2009 to remove the retaining walls in violation and he has decided not to
appeal the Zoning Board’s decision.
Locher will watch this location for compliance.
The Board had a discussion on towing versus citing junk vehicles in the
village. The village will continue to
cite the owners of junk vehicles in violation.
If the owner of the vehicle is not in compliance by the date given then
it will result in a citation to be addressed by the
Municipal Court. The village is still
working on getting the towing process in place for the village.
The
village has paid $775.00 to have the grass mowed at the old latex factory this
year. Michelson will look into putting a
lien on the building for this money the village has paid
out.
Michelson had a list of eleven items in the zoning book that he thought
the Board should address. Some of the
items were just old wording that doesn’t apply anymore
and other items need clarification.
There has been no date set yet for the next Zoning Work Session to be scheduled by Cyndy Naragon.
Osborn reports that the Zoning Board held their regular meeting on
Tuesday, October 6, 2009 at the village hall.

Joe Elasser of 54 Willow Wood was given until September
30, 2009 to stack the wood against his house that was in a pile.

Zoning
(Continued): It looks like the wood was stacked, but now
there is an additional pile that has been delivered. The Board and Locher will suggest that Joe
attend the next Zoning meeting to discuss a remedy to this situation.
Locher
has received two applications for permits for the Wolff property at 90 Longacre
Lane. A $150.00 check was
received for the previous work done, late fee and a permit fee for this
work to be done again. The drawings
submitted are not sufficient as they do not denote the
second retaining wall. Locher to
discuss this with Wolff and request more complete drawings,
measurements, etc.
A
discussion was held wondering if the rocks are too
close to the road again on Northvale.
The boulders appear to be where the Board asked them to be placed a few years ago.
No further action.
Osborn said the Council needs to give a second reading to the pending
dumpster ordinance.
Locher
received a complaint about Mr. Reams at 7 Bungalow Bay
building a fence on the garage/house roof and repaving his driveway without a
permit. Locher said as
of October 5, 2009 there is no evidence of any construction at that location. Locher also checked the auditor’s website and
there have been no differences in the shape of the driveway.
Joe Londrico on Bass Bay is putting sod on his lawn and it looks very
good.
Osborn reports that Locher presented a list of 38 completed
violations. There are only six
violations pending and that he is working on.

Zoning
(Continued):
The next Zoning Board meeting will be Tuesday, November 3, 2009.
The Law
Director said he sent a letter to the owner of the property located at 115
Clover Cliff. Someone filled in the
ditch at the front of the property without putting drainage in. The
residents are also parking on this gravel area which
is a violation of a village ordinance.
The owner called the Law Director right away after receiving his
letter. The owner stated he would be
putting in drain tile and he would not park on that area.
Council prepares to give Ordinance #685-09 a second reading. The Law Director wants to know if there are
any changes needed to this ordinance. If
not, he wants to put an ad in the paper for a public hearing to held at the
next Council meeting on November 9, 2009.
Since this would be a zoning change there needs
to be a public hearing. Ordinance #685-09 “An ordinance amending
the village zoning code in order to add the definitions of a dumpster and a
swimming pool and provide regulations for dumpsters within the village.” had its
second reading.
The Law Director said that Ordinance #686-09
needs a second reading. He explains
that this pending ordinance would add a fee of $100.00 as an administrative fee
if the village has to use state law to get somebody to clean up their rubbish,
debris or correct a hazardous condition on a property. This is a procedure where if it is determined
that a problem exists, the owner is notified to take care of it and to clean it
up. If the owner doesn’t
take care of it then the village can take care of it and charge the owner the
administrative fee in addition to the cost of service.

Zoning
(Continued):
Ordinance
#686-09 “An ordinance establishing an administrative fee to be charged to the
property owner when the village must correct hazardous conditions, cut weeds
and other growth and remove litter, rubbish and debris from private property
within the village and charge the same to the private owner.” had its second reading.
Finance: Cathy said that Alan Robbins was sworn into office on July 13, 2009. Before he was sworn in
there was an approval of $2,000.00 to purchase five ordinances boxes from
Plastic Lumber Company. That company has had a name change and is now Bright Ideas Shop,
LLC. Cathy would like the record
to reflect that the $2,000.00 approval be adjusted to Bright Ideas Shop, LLC
instead of Plastic Lumber Company. Motion made by Riedel to adjust the
approval to Bright Ideas Shop, LLC.
Osborn seconded. 5 Ayes, 1 Abstain.
Motion approved.
Cathy reviews the bank statement ending
September 30, 2009 and the accounting reconciliation sheet with Council. They have been given
copies of these documents and Cathy asks for their signatures on her copies.
Cathy presents the monthly Cash Summary by Fund report. She said the starting balances in all funds
which are the General Fund, Streets Fund, Permissive Fund, Pochedley Trust Fund
and the Parking Violations Bureau as of September 1st
through today’s date were $233,407.87.
The revenue collected and deposited were $12,017.68 and the expenditures
were $27,161.04.

Finance
(Continued): The Star Ohio balance is presently
$12,276.15. The checking balance is
$205,988.36.
Cathy presents and reviews the third quarter reports in detail with
Council and Mayor. She first explains
the Revenue Status report showing all revenue collected from January 1st through September 30th. She then goes over the Appropriations Status
report for the same time period. She points out what was
appropriated at the beginning of the year, actual dollars encumbered so
far and the balance of the remaining appropriations. All members of Council and Mayor Dodaro have
copies of these reports.
Hunter said that she brought this up before but she states that it is real important when residents are buying license stickers
and plates to say they are from Chippewa Lake.
Cathy said it is important to be even more specific than that because
you can have a Chippewa Lake address and be a resident of Gloria Glens or
Lafayette Township. She asks residents
to say that they live in the Village
of Chippewa Lake so that we receive the $10.00 license tax that comes
back to the village.
Cathy said as always please interrupt her or call her later with any
questions. Mayor Dodaro and Council thank
Cathy for her report.
Cathy said the county auditor would like Council to pass a resolution accepting
the amounts and rates as determined by the budget commission. This resolution needs to be
sent to the auditor by no later than November 2, 2009. Motion made by Riedel to waive the 3 reading requirement for Resolution #428-09. Hunter seconded. 6 Ayes. Motion approved.

(Continued): Resolution
#428-09 “A resolution accepting the amounts and rates as determined by the
budget commission and authorizing the necessary tax levy and certifying them to
the county auditor.” was read by title only. Motion made by Hunter to adopt Resolution
#428-09 as an emergency. Osborn
seconded. 6
Ayes. Motion approved.
The
Law Director will review the agreement between Varney, Fink & Associates,
the State Auditor and the village and address this later in the meeting.
Buildings: Sommers reports that Mike Gorfido of MG
Concrete completed the floor in the addition of the building last week. He did the concrete floor in the larger part
of the building last year.
Sommers said the village received a proposal from Lake Refrigeration in the amount of $12,750.00 for the heating and cooling
work. The proposal states to upgrade to
heat pumps the village should add an additional $1,400.00 to this cost. Sommers
said the proposal is not itemized so if we decide to
go with this company we would need more definition.
Riedel said he thought the village had an electrician to work with us,
but he has not returned any phone calls or submitted any documentation as
requested. Dee Dee Duecker recommends
that Riedel contact Randy Burke who might be willing to work with the
village.
Community
Relations: (See attached
report) Mayor Dodaro said that Robbins attended the Soil & Water
meeting on behalf of the village recently.

Relations (Continued): She said he also
attended the Mayor’s meeting on her behalf as she had a death in the family and
couldn’t attend.
Mayor Dodaro thanked him for attending these meetings.
Robbins said the community calendar on the internet has been in place
and the village is getting some nice comments on it. Claire List would like to promote this
village calendar on their website to make people more aware of it.
Pam Williams who heads the Pride Program said they will
be having their last meeting of the year with the date to be announced to plan
activities for next year.
Robbins thanked Claire List who heads up the Neighborhood Watch for
alerting the residents by email with important information very quickly. Claire said she has about 120 email addresses
from village residents that receive her updates.
Robbins said he did see the Chippewa Lake Waterski Team at the Barberton
Mum Festival. He said they did a good
job performing.
Robbins said the Lions Club will be having
their Fall Festival this Saturday, October 17th at the Point
Park. The Lions Club will also be
holding their annual holiday fruit sale.
Robbins said that 2010 is a census year.
There will be an active count of residents on April 1, 2010. He said the county planning committee is
having what they call a “Complete Count Committee” to help organize census
issues on our community and that meeting will be on October 28th at
9 am. Robbins said that all residents will receive a ten question census.

Community
Relations (Continued): If you don’t respond the first time then they will mail out a
second form. If you don’t
respond the second time then people will actually show up at your door to
obtain this information. They are
looking for ways to get the word out how important this information is. Part of the census is how the village would
get dollars for grants and finances of that nature. Riedel asks how they address the homeless people. Robbins said that is a good question and that
he doesn’t know the answer at this point.
Robbins said he attended the recent Soil & Water Conservation
meeting. They are doing a “Balance
Growth Program” which pertains to the Upper Chippewa Creek Watershed. They are seeking a grant to study Commercial
and Conservation watershed aspects of Upper Chippewa Creek. Robbins said it basically
starts at the continental divide and weaves through the county area. This study is only for commercial and
conservation issues. Commercial means
commercial and industrial properties and conservation means wetlands and agriculture. It does not address residential issues. Robbins said the village did get a letter
dated October 1st and he thinks he should
cooperate with them. They will be using
the villages and townships in the area to wrap this up by lending their support
to apply for the $75,000.00 grant to study this proposal. The Law Director said with this
resolution all it says is that the village is willing to consider participating
in this program if they do the study. It
is not binding in the sense that the village is not committing any resources or
way in with the plan that they come up with.

Relations (Continued): This resolution
states that the village supports their formulation of the plan and the
resolutions are required in order for them to apply for the grant. Motion made by Riedel to waive the 3 reading requirement for Resolution #429-09. Bican
seconded. 6
Ayes. Motion approved. Resolution #429-09 “A resolution stating the willingness
of the village to participate in the Balance Growth Initiative for the Upper
Chippewa Creek Watershed.” was read by title only. Motion made by Hunter to adopt Resolution
#429-09 as an emergency. Robbins
seconded.
6 Ayes. Motion approved. Cathy will mail a copy of this resolution to
the Medina County Soil & Water Conservation Department. Motion
made by Bican to nominate Alan Robbins to serve on the Watershed Planning Task
Force. Hunter seconded. 5 Ayes, 1
Abstain. Motion approved. This commitment involves about six
meetings in 2010 and two meetings in 2011. Hunter thanked Robbins for being on this
committee and Robbins said he was glad to do it. Cathy
will include a letter with the resolution stating that Council has recommended
Robbins for this position on the task force.
Robbins said the health department did talk about H1N1 and the vaccines
coming out. This flu does seem to be
prevalent, but not as bad as anticipated.
They said that the vaccine will be available to health workers, hospital
workers, school and then to the general public as he
understands it. This flu seems to be
affecting the young ones which refer to one year olds
to twenty-six year olds and also pregnant ladies. It is a personal choice to decide to get the
H1N1 flu shot or not.

Community
Relations (Continued): Hunter said she
read that they are not encouraging schools to close when the infection is
located there and just keep the normal school operation schedule. Robbins did say that if you have flu symptoms
to go home and not return to work or school until you have been fever free for
24 hours.
Robbins wanted to touch on park and lake issues. Robbins is hearing concerns about lake boat
and dock decisions as it relates to the Parks District. He has reported before that the level of
communication between the community and the Parks District is non-existent
right now. The rumor mill is working and
it is not clear what is rumor or fact. Robbins
said he has checked the website of the Parks District and there is no mention
of any upcoming meetings. After much
discussion, Riedel said he would contact Tom James of the Park District for an
update and report back to Council. Sommers
advised Robbins that the village has a Parks District link on our website and
it has been there for a long time.
Robbins wasn’t aware of this.
Mayor Dodaro said that the village’s stand since the Parks District
bought the lake has been let’s wait and see what their
ideas are. She said that for the most
part their ideas so far have been favorable for our residents. She said we are allowed to use our boat ramp,
have our docks out and the ski team still skis and we
have no reason to believe that he is going to change that. Mayor Dodaro said Tom James has never lied to
us about anything and she says he is pretty up front
about what he wants done.

Community
Relations (Continued): Tom Melter said
he agrees with Mayor Dodaro, but believes a meeting is in order with Tom James
to get some clarification. Mayor
Dodaro agrees it has been awhile since a meeting was held. Robbins said the last meeting of the Advisory
Committee was on October 8, 2007.
Robbins said the main thing we are trying to strive for is better
communication.
Cathy told Pam Williams that the water meters will
be pulled on October 23rd so the water will not be available after
that date until the spring.
Parks: Bican said she received a proposal from Bill
Zweifel for leaf pick up this season. He
quoted $1,200.00 to pick up all bagged leaves set by the road within the
village limits. He asked that the bags
not exceed fifty pounds and he will begin picking up on
November 9th. Motion made by Bican to accept Bill
Zweifel’s proposal of $1,200.00 for leaf pick up. Robbins seconded.
6 Ayes. Motion approved.
Bican said that Bill Zweifel submitted a proposal cost of $2,250.00 to
clear the brush and small trees in the Reese’s Pond area. Motion
made by Bican to accept the proposal from Bill Zweifel to start clearing the
Reese’s Pond area in preparation for the park plan. Hunter seconded. 6 Ayes. Motion approved. Bican will contact him to let him know it is approved for him to start clearing.
Mayor Dodaro asked Bican if the mosquito spraying was
done. Bican said she thought he
was done. Cathy said he is done and his
bill was marked final for the season.

Streets: Riedel said that the Sanitary Engineers
project up on the circle is done. They did kill a huge ash tree and they are
aware of it. They are responsible for it and paying for its
removal.
Riedel will be meeting with John Rice of
Engineering Associates to go over Phase Four which
will be the Craggy Creek project.
Discussion will be held about where Craggy
Creek will connect with Chippewa Road and Beachside Blvd.
Mayor Dodaro asked if Engineering Associates have filed the Phase Five application.
Riedel said yes they have.
Reid Road, Briarwood Oval and the top section of Clover Cliff has been
chip & sealed by Lytle Construction today.
Riedel said that the bids will be sent out in
January of 2010 for Phase Four.
Law
Director: The Law Director said that the village does
need to pass an ordinance to approve the auditing contract with Varney, Fink
& Associates. Motion made by Riedel to waive the 3 reading
requirement for Ordinance #687-09.

signs four places and Cathy will make a copy of this document and mail them
back to the Auditor of State for approval.
The Law Director said the
village needs to update our traffic and criminal codes for the village. He finally got a quote from the Walter Drane
Company. He said we could get this
material either in printed form or in PDF printable digital form. The printed copies are $80.00 each. The PDF form is $95.00 and we can print as
many copies as we need. Motion made by Riedel to encumber up to
$95.00 to purchase this PDF form of the village traffic and criminal code. Robbins seconded. 6 Ayes. Motion approved. The Law Director will order this and get
an invoice from them.
The Law Director said he has four cases to report on tonight. The first case was a guilty plea to
threatening domestic violence and the defendant will be sentenced on October 20th. The
second case was a guilty plea to a tail light violation and a fine
imposed. The third case is a charge of
driving with a suspended license set for trial on October 28th. The last case is for criminal trespassing which is set for jury trial on November 10th.
The Law Director said that the village does own a lot in the Village of
Gloria Glens. They want to vacate the
road that the village owned property is on. Motion
made by Riedel to act as a good neighbor and donate that property on Twilight
Trail to the Village of Gloria Glens.
Sommers seconded. 6 Ayes. Motion approved.
The Law Director will draw up a resolution for passage at the next
Council meeting on November 9, 2009.
