The Village of Chippewa Lake Council met in regular session on Monday, September 14, 2009 at the Church at
the Lake located at 7824 Lake Road.
The Honorable Joanne Dodaro called the meeting to order at 7:30 pm.
All in attendance stood for the Pledge of
Allegiance.

made by Riedel to pay the bills from their proper funds. Osborn seconded. 5 Ayes. Motion approved.
It will be discussed next month whether to
keep Ordinance #573-03 which is the uniform allowance
ordinance for deputies who work 375 hours and over in a specified time
period.
Mayor Dodaro asked if any of the following
people were present pertaining to their vehicle violations: Benita Sorgi of 279 Park Lake, Patsy Hannahs
of 100 Briarwood Blvd, Holly Downing of 37 Circle Crest and Peggy Jones or
Richard Morrison of 121 Clover Cliff.
None of the above people were present. Motion
made by Riedel to give the above named people until September 21, 2009 to
correct the violations or be cited. Osborn seconded. 5 Ayes. Motion approved.
The village has received three snow plowing bids that are sealed and ready to be
opened. Riedel opens the sealed
bids. The bids received are from Mihalik
Maintenance, Jenkins Maintenance and Peters Professional Lanscaping. The bids for plowing were
compared by hourly pricing.
Mihalik was $65.00 per hour, Jenkins was $44.00 per hour and Peters
Professional Landscaping was $55.00 per hour when using a three-quarter ton
truck.

When spreading salt, Mihalik and Peters would
charge $75.00 per hour. Jenkins would
charge $54.00 per hour. The village has
a contract with the county to purchase road salt from them. After discussion, Motion made by Riedel to accept the proposal from
Jenkins Maintenance for the 2009-2010 snow plowing season.
Osborn seconded. 5 Ayes. Motion
approved.
Ordinance
#684-09 “An
ordinance accepting the bid of Jenkins Maintenance Company, Inc for snow
plowing services for the village for the 2009-2010 winter season and declaring
the same an emergency.” was read by title only.
Motion made by Riedel to waive the three reading requirement for
Ordinance #384-09. Hunter seconded. 5 Ayes. Motion approved. Motion made by Riedel to adopt Ordinance
#384-09 as an emergency. Sommers seconded.

Jenkins Maintenance that the village needs proof of workers’ compensation
coverage and a certificate of insurance liability of no less than one million
before any work begins.
Alan Robbins asks what the cost of snow plowing averages per season. Cathy said it depends on the snowfall, salt
prices and the company. Last winter from
November 2008 until January of 2009 the village spent over $30,000.00 on
plowing and salt charges in that period.
Robbins asked if we had an option to salt or not. Mayor Dodaro and Riedel agree that the
village wants to salt the hills and intersections only this season.
The other roads will just be plowed.

Mayor Dodaro gave her thanks to everyone who
helped over the Labor Day weekend. She
thanked the ski team for the good shows they gave. She recommended viewing the pictures through
the ski team website. She said she wasn’t just saying that because there is a spectacular shot
of her grandson. Everyone laughed at her
comment. She thanked everyone who helped
at the dance and those who donated food and door prizes. She thanked Bob Moats for his donated
original prints that really were in demand.
She thanked Tom and Claire, Cynthia Wood, Jeannette Rhyner, Dan McGahan,
Keith Riedel and Cyndy Naragon for their donations and their physical help that
evening. She gave a special thanks to
her husband, Bob, for his help on the grill.
They donated $1,055.00 to the village parks after the dance.
Committee Reports
Safety: A meeting with Sheriff Hassinger, Deputy
Tracy Easterday, Barb Hunter, Allan Michelson and Mayor Joanne Dodaro will be
held on October 19th at 7 pm at the
sheriff’s department to discuss many issues about police patrol in the village.
Barb Hunter read the patrol report for the month of August as
follows: 13 calls assigned by dispatch,
½ hour working on reports or calls, 8 self-initiated calls, 1 written report
taken,
99 vacation watches, 148 citizen contacts, 4 traffic stops,
8 citations issued, 5
warnings issued, 10 suspicious persons,
10 suspicious vehicles,
10 assists to other police departments and 1 presence at fire-rescue call. (See
attached report)

Safety
(Continued): The deputies worked a total of 173 hours for
the month of August. They logged 1,004.8
miles on the cruiser using 101 gallons of gasoline.
Hunter asked if the “Chippewa Lake” magnets are still
being put on the cruiser when in use for the village. Allan said this was started
more as a community presence. Deputy
Easterday will remind the deputies to put the magnets on the cruiser when
patrolling our village.
Pam Williams asks if we could schedule patrol for in the middle of the
night when people are out roaming around.
Mayor Dodaro said that is one of the reasons we are having a meeting
with Sheriff Hassinger to know when our officers are out. Hunter refers to the schedule of past hours
and it shows when the officers have been during the early morning hours.
Fire Chief Hall distributes the monthly activity report for July. It shows that the village had 2 fire calls and 2 EMS calls for the month. The year to date totals for the village are 15
fire calls and 27 EMS calls. (See attached report)
Chief Hall said that they transport to the
three hospitals in the county which are Medina, Lodi
and Wadsworth. The patient is billed through their insurance company or Medicare
whichever is applicable.
Chief Hall said there are some low hanging trees in the village that
needs attention. Riedel asks for a list
of the areas that need attention and he will have them taken care of.
Chief Hall said that will be getting a new fire
engine sometime in February of 2010.

Chief Hall said that any children (boys or girls) fourteen and over are
eligible to join the cadet program with the fire department. At age eighteen they
can join the fire department. Sommers
asked what kind of things would they be expected to do. Chief Hall said that
basically they help out the firefighters. They might be asked
to do things like change their air bottles.
He said they make great “go-fers” which is very helpful. Mayor
Dodaro said that is where Jeff Hall and Brad Winter first started with the
department.
The fire department has started their “bike patrol”. There will be two men or women wearing bright
yellow shirts riding around the village.
The bikes are outfitted as EMS bikes.
Robbins asked about the boat that capsized in the evening a few weeks
ago. Chief Hall said they transported
two males that were hypothermic. The
sheriff’s department turned the matter over to the Parks District who along
with ODNR is investigating this incident.
Robbins asked about what is the procedure about getting the old park
property cleaned up. Brad said they have
been trying to get those old buildings condemned for quite some time. Cathy said it is documented
in village minutes that several months ago Debbie Bican brought this subject up
at one of our council meetings. Brad
Winter said he spoke with Gary Sills about getting those buildings taken down
very soon. Three months and waiting is
not very soon. Mayor Dodaro is also
concerned about those buildings and the safety of those who live around there
and she’s sure the township is too. Brad Winter will bring this up again to the
Lafayette trustees at their next meeting on Monday.

Safety
(Continued):
The fire department will hold a first aid class on October 1st
per the request of the village’s Neighborhood Watch program.
Assistant Fire Chief Brad Winter reported that the township has had some
results with the cleaning up of the “second hand store” and wondered if it was noticed. Mayor
Dodaro said it looks much better and their efforts to clean up are appreciated.
Mayor Dodaro said the store even donated some items for the Labor Day dance.
The Village of Chippewa Lake will observe Halloween on Saturday, October
31st from the hours of 6-7:30 pm. If you would like to participate
please leave a light on.

Zoning: Osborn said that the Zoning Board held their
second work session meeting on August 20th
at 7:00 pm. (See attached minutes) Osborn
reports that Bob Locher investigated thirty-one properties, but admits he has
not sent out all of the letters. He was
gone for a week with DARE training for the sheriff’s department. He will have all of the letters mailed out by
August 22, 2009.
The Board discussed the duties of the Zoning Administrator
which are to identify properties with potential violations and provide a
list to the Zoning Inspector to investigate further and report back to the
Zoning Board. The Zoning Administrator’s
main focus should be on the zoning book.

Zoning
(Continued): If Naragon is questioned by
a resident she should direct them to contact Locher.
Bob Locher provided information on Kurtz Towing who will tow vehicles
for the village when all paperwork is in place. Locher has spoken to Deputy Easterday about
the towing procedures. In the meantime,
vehicles in violation will be cited. The ordinance states that each day is a
separate violation. The Law Director’s
advice is to cite them once and run them through municipal court. If that has no
effect then cite them again.
The Zoning Board had Allan Michelson define some legal questions for
them. One was defining the difference
between a temporary and permanent structure.
Allan also advised that the zoning book defines
what requires a permit, time limits and expiration dates. Allan also stated that it was his opinion
that the retaining wall at 90 Longacre was a permanent structure and that it should be taken out.
Since a permit was taken out late the cost will
be $150.00.
Locher suggested that the zoning book wording that junk vehicles must be removed from the village and not just from the
property. There was a situation where a
vehicle in violation was just moved from a resident’s
property to a neighbor’s property.
The Board had a discussion on how to inform new residents that the
village is a zoned community. Two ideas
were to put this information in an upcoming newsletter and another idea was to
send out letters to all property transfers into the village.
The next work session is scheduled for Thursday, September 17th at
7:00 pm at the village hall.

Zoning
(Continued): Osborn said the Zoning Board held their
regular meeting on Tuesday, September 1, 2009 at 7:30 pm at the village hall. (See attached minutes) Joe Elsasser of 54 Willow Wood was present to
ask for additional time to move the wood pile on his
property. He wanted to give the
painters time to finish and asked for an extension of time until September 30th. The
Zoning Board granted this extension of time.
Lester and Linda Hannahs were told that have until September 14th to move the wood pile, not September 1st
as they thought. He believed that was
sufficient time to address this problem.
He asked that all future notices be sent to 100 Briarwood Blvd and that was noted by the Board.
The
Board asks for Michelson’s opinion on the right of way issues concerning the
retaining walls at 90 Longacre. The
Board decided that allowing building of structures in the village right of way
is not a good idea and they voted to have the retaining walls removed by
October 15th. Mayor Dodaro reported that Mr. Wolff’s
landscaper called Bob Locher and they are going to move the wall.
The Board reviewed Bob Locher’s violation list from August 30th. He
completed twenty-one items. Four items were turned over to the sheriff’s department so they could
cite the owners. There were fourteen
additional property violations where contact has been made
with the property owners, but the situation has not been completed yet.
Mayor Dodaro said that the Zoning Board, Zoning Inspector and the Zoning
Administrator are doing a good job.
Osborn said he would like to second that.

Zoning (Continued): The Zoning Board has
approved the dumpster ordinance and makes its recommendation to Council for
their review of this proposed ordinance.
Ordinance #685-09 “An ordinance amending the village
zoning code in order to add the definition of a dumpster and a swimming pool
and provide regulations for dumpsters within the village.” had its first
reading.
The Law Director said the idea behind this
ordinance was there were several situations where the village notified the
property owner and when the owner doesn’t act then the
village pays to have the situation corrected.
The charge is passed along on the property
owner’s tax bill. With this proposed ordinance any service that the village has to take care of
because the property owner won’t correct after being notified will add an
additional one-hundred dollar administrative fee plus the charge for the
service to their tax bill. Cathy adds for
the record, this was discussed in your minutes from last month so this isn’t something just now being discussed. The Law Director needed time to draw up an
ordinance. Ordinance #686-09
“An ordinance establishing an administrative fee to be charged to
the property owner when the village must correct adverse conditions, cut weeds
or other growth, remove litter, rubbish or debris from private property within
the village and charge the same to the private owner.” had its first reading.
The Law Director said in order to get a towing company to tow a vehicle off of private property and not have to pay up front by the
village there has to be a complaint number and a towing order from an
officer.

Zoning
(Continued): One of the assistant prosecutors thought the
village had to change our ordinance to do that, but she was looking at a
township law. The Law Director sent her
materials and what he thinks gives us the right to go ahead and do this. Since they are the attorneys for the
sheriff’s department the department wouldn’t act until
they sign. In the meantime, Michelson
has told Locher that the owners of vehicles that should have
been towed should be cited anyway.
This citation will go to Medina Municipal Court and he believes that
will get their attention also.
Osborn said there was a question that came up about culvert pipes and
there are three properties on Clover Cliff (93, 115 and 116) brought to the
village’s attention. Osborn said that he
and Riedel went to the location and found that the ditches in front of those
properties have been filled up with gravel. The property at 116 Clover Cliff appears to
have a culvert pipe in it, 115 Clover Cliff doesn’t
appear that a culvert pipe was ever put in and 93 Clover Cliff never had a
ditch. Osborn asked the Law Director if
this is a zoning issue or a Council issue.
The Law Director said it is a Council issue because it’s not
construction, it’s drainage. Michelson said there is a state law that
states you can’t obstruct a drain, a culvert or a
natural waterway. Osborn asks how should the village notify the resident that they are in
violation. A letter will be sent
by Michelson to the owners at 115 Clover Cliff advising them that a culvert
pipe needs to be installed. They are
also parking on the gravel now and will be cited by a village deputy for
parking on yards which is a violation of a village
ordinance.

Zoning
(Continued):
Osborn said that the next Zoning Board meeting is scheduled
for Tuesday, October 6, 2009 at 7:30 pm.
Mayor Dodaro gives Jerry from the Medina
County Auditor’s office an opportunity to speak to those in attendance. Jerry said the auditor’s office is currently
running a couple of contests that they do every year. The first contest is called
the “Top Dog” contest open to all fourth graders in the county. They are to write an essay about why their
dog should be the top dog in the county.
This contest will run through November 13th.
The second contest is designed for older
students and they must go to school in Medina County. They are to design the new seals used by the
county auditor’s office next year on gas pumps, cash registers and scales in
the county when they inspect them. This
contest will also run through November 13th.
Finance: Mayor Dodaro thanked Cathy for the nice
letter that she sent to John Kindall pertaining to his resignation.
Cathy presents the bank statement and
accounting reconciliation ending on August 31, 2009 showing all balances are
reconciled. She asks all members of
Council to sign her copy acknowledging that have seen this document. The auditors love to see those signatures.
Speaking of auditors, preparation is being made
for another state audit to be performed next spring. This audit will be for 2008 and 2009. As soon as Cathy gets the estimate of cost she will present that to Council. It will need to be included with the 2010
village appropriations.

Finance: Cathy
said the Cash Summary By Fund is the other report for
tonight. The figures on this report
reflect activity from August 1, 2009 to September 14, 2009 before the approved
bills are paid. The starting balance in
all funds which are the General, Streets, Permissive,
Pochedley Trust Fund and the Parking Violations Bureau was
$203,947.08. The revenue collected and
deposited was $52,352.76 and the expenditures were $23,067.51. Star Ohio presently has a balance of
$12,274.41. This leaves the checking
balance at $220,957.92.
Cathy said she will present the third quarter
reports next month. This concludes her
report for this evening.
Buildings: Sommers said she has nothing to report. Riedel said that the plumber has picked up a
set of the plans. As soon as those are reviewed by the health department he will pick up
the plumbing permit. Once the permit
has been received the installation of the water and
sewer pipes will go in the floor. When
this is completed we will move forward with bids on
the concrete in the addition area and HVAC work. The village is still looking for an
electrical contractor who would be willing to work with the village.
Community
Relations: Robbins said he has worked with Sommers to
create a community calendar. The website

tool to keep residents advised what is coming up.

Community
Relations (Continued): Robbins wasn’t sure if Sommers would continue to maintain the
village’s website. She said she would
like to continue to do that.
Pam Williams said that the CVPP party was a huge success with about 300
people attending this year. Pam said
they raised a lot of money for next year.
Pam said they are still working on having a movie night. Deputy Easterday said he spoke with the
prosecutor and he said that since no money is charged to watch the movie they can show the movie anywhere.
The Law Director did not think that was correct.
Pam said their three farmer’s markets were a success. They are looking forward to next year. They are open to any suggestions or new
ideas.
Robbins said that Claire continues to do a terrific job with the
Neighborhood Watch and keeping everyone advised.
Tom Melter is here from the Ski Team and
Robbins praised the team for a great Labor Day show. The ski team will be performing at the Mum
Festival in Barberton on September 26th and
27th. They will ski three
shows on Saturday and again on Sunday. Tom said that the ski team is developing a
five-year plan which they are hopeful will allow them
to go to the next level of competition. Tom
said that the ski team has cleaned up the beach and everything has been put away.
Lions Club is having a festival on Saturday, October 17th
from 11 am to 4 pm at the Point Park. There
will be drawings, games, music and food.
Bob Williams asks for Council’s permission to hold the festival at that
location and also permission to block off Beachside
Blvd for this festival.

Community
Relations (Continued): Motion made by Robbins to allow the Lions
Club to use the Point Park for their October 17th
Festival and to also block off Beachside Blvd for this event. Bican seconded. 6 Ayes. Motion approved.
The Lions Club provided thirty-five backpacks which helped many village school children get
ready for school. They will also have
their annual fruit sale.
Robbins did call Tom James about village representation concerning lake
decisions. It has been about eighteen
months since the committee has met. Mr.
James did mention Mayor Dodaro, Keith Riedel and Paul Vereb as a few of the
members on the existing committee. Robbins asks about getting on this committee
and Mr. James didn’t think he needed one more person. He said he didn’t
mind if Robbins attended a meeting.
Robbins asks to be notified when the committee meets again as he would
like to attend the next meeting.
Parks: Mayor Dodaro thanked the ski team for
cleaning up the beach and closing it down for the winter.
Bican apologies for arriving late to the Council meeting. She had another meeting before this one and
it lasted longer than expected.
Bob Moorhead of G&O Spray Service is still spraying for mosquitoes
and Bican has left the spraying up to his discretion as to when it is safe to
stop.
Bican said that Jim Butch is working on plans for Pochedley Park/Reese’s
Pond area.

Parks
(Continued): The village has paid Barb Arnold $750.00 for
her part of the design work, but Jim Butch has donated his time. The village appreciates his help.
Bican said there has been a request to have some dead trees taken down
on the hillside of Bungalow Bay Blvd.
She has an estimate from Chippewa Valley Tree Service to have this work
done at a cost of $2,900.00. Randy
Baird has offered to give the village a donation to have this work done. Bican
said Council will need to decide whether to accept
this donation and agree to have this work done. Mayor Dodaro and Keith Riedel went to the
hillside to look at the trees that were being considered to
be removed. The Law Director
advised that someone from the village be present when the trees are being taken down.
Riedel plans to supervise this job.
The contract should be between the tree company and the village since the trees are on village property. The village will need proof of workers’
compensation and a certificate of insurance liability before any work is started. Riedel
will obtain the donation from Randy Baird for this work. Motion made by Bican to hire Chippewa Valley Tree Service to remove the
specified dead trees on the hillside of Bungalow Bay Blvd contingent upon
receiving the donation of $2,900.00 from Randy Baird for this work and
providing Chippewa Valley Tree Service provides proof of workers’ compensation
and a certificate of insurance liability to the village prior to the work being
done. Robbins seconded. 6 Ayes. Motion approved.

Parks
(Continued):
There is also an ash tree on the circle of Bungalow Bay that was
damaged as a direct result of the road construction in that area. Riedel plans to advise the County Sanitary
Engineers that this tree should be taken down.
Streets: Motion
made by Riedel to encumber an additional $2,041.50 to have Lytle Construction
to do chip and seal on Briarwood oval, Reid Road and the upper section of
Clover Cliff. Osborn seconded. 6 Ayes. Motion approved.
The auto-paving on Bungalow Bay should be
starting on Monday of next week.
Approximately ten days after that then they will be applying a chip and
seal surface to the new road.
Riedel and Engineering Associates have walked Craggy Creek several times
now. When the bridge project was done it was pointed out by the property owner that part of
the road is on her property and she’s not happy about that. Craggy Creek is going to be done properly and
road will be straightened out now. Medina County Sanitary Engineers will not be connected with this project on Craggy
Creek. This project will begin in the
spring of 2010.
Engineering Associates are working on the application for funding of
Phase Five which will be for Heather Hedge, a small
section of Rockridge and Lazywood. This
project is slated for 2011.

Law
Director: The Law Director said he has four cases that
are pending to report on tonight.

Law
Director (Continued): The first case is
a charge of domestic violence with a trial date of September 24, 2009. The second case is a guilty finding of
persistent disorderly conduct with sentencing pending. The third case is for operating a motor
vehicle under the influence of alcohol and a license plate display light out. This case is set for hearing on September 25,
2009. The last case is a jury trial on
September 29, 2009 on a criminal trespassing charge.
Old
Business: Mayor Dodaro said on the Fourth of July that
Bobby Duecker won a fifty-fifty raffle.
At the Pride Program’s party Richard Duecker
won their fifty-fifty raffle. At the
Labor Day raffle Dee Dee Duecker won. Mayor Dodaro gave her congratulations to
this lucky family.
New
Business: Dee Dee Duecker announced that there will be a blood bank on October 8th at the Church
at the Lake from 3-7 pm.
Mayor Dodaro congratulated Tom Melter who will be a new member on
Council when it is called to order in January of 2010.
Motion
made by Riedel to go into executive session to discuss patrol hours and
personnel issues. Robbins seconded.
